Terms and conditions of sale

These terms govern sales made on the Chauvire Bijoux website.

This translation is provided for information only: only the French version is legally binding.

1. Purpose

These general terms and conditions of sale govern the relationship between Chauvire Bijoux and anyone making a purchase on the website. Placing an order implies full acceptance of these terms.

The seller is Chauvire Creations, sole trader, CDV 239578, 350 chemin de Pré Neuf, 38350 La Mure, France — SIRET 107 936 114 00019.

2. Products

Our jewellery is handmade, gold-plated or gold filled, with natural stones, mother-of-pearl and cultured pearls depending on the piece. Images are as faithful as possible; slight variations (shade, patina) are inherent in the handcrafted nature of the pieces.

3. Prices

Prices are shown in the currency displayed on the website, with any taxes in accordance with applicable regulations. Chauvire Bijoux reserves the right to change its prices at any time; the price applied is the one in force when the order is placed.

4. Orders

The order is confirmed once payment has been confirmed. A confirmation email summarises the items ordered.

5. Payment

Payment is made using the methods offered at checkout. Transactions are secure. The payment provider used for all orders on the website is Stripe.

6. Delivery

Terms, areas and lead times are set out on the Shipping & returns page.

7. Right of withdrawal & returns

Return conditions and exceptions (personalised and made-to-measure pieces) are set out on the Shipping & returns page.

8. Warranty

Our creations come with a 2-year warranty against manufacturing defects.

9. Referral programme & credit payout

The referral programme is a free commercial benefit reserved for customer account holders. The referred person receives 10% off their order; the referrer receives 10% of the amount actually paid, excluding shipping, as a credit added to their account. This credit becomes usable once the withdrawal period for the order concerned has expired, remains valid for 6 months and is cancelled if the order that generated it is cancelled, returned or refunded. Full details are given on the Referral programme page.

The credit is personal and non-transferable. It is intended to be deducted from an order placed on the website. The referrer may, however, request a cash payout of their available credit, on the following conditions:

  • a 25% reduction is applied to the amount paid out;
  • the total amount paid out to the same referrer may not exceed €265 per calendar year, corresponding to 15% of the French gross monthly minimum wage (SMIC), unless Chauvire Bijoux gives prior and express agreement, subject to conditions;
  • beyond this cap, the balance not paid out remains available on the website for any future order, within its validity period;
  • only available credit may be paid out, excluding earnings still awaiting maturity or expired.

Requests must be sent by email to bijoux.chauvire@gmail.com, from the address associated with the customer account, stating the amount requested and an IBAN in the account holder’s name. The net amount is confirmed before the transfer, which is made within thirty days of approval. Chauvire Bijoux reserves the right to refuse or suspend a request in the event of abusive or fraudulent use of the programme, and to amend these terms for the future, credits already acquired remaining governed by the terms in force on the day they were granted. It is the referrer’s responsibility to make any declarations required of them in respect of the sums received.

10. Gift cards

The gift card is a bearer instrument for a prepaid amount, delivered electronically to the email address given when ordering. It can be used across the whole shop, in one or more goes: any unused balance remains attached to the code until it is used up or expires.

  • It is valid for 12 months from issue, i.e. the date of the order with which it was bought. A reminder is sent one month before expiry if there is any balance left; after that date, the unused balance is lost.
  • It cannot be topped up, refunded or exchanged for cash, including for any remaining balance.
  • If the order amount exceeds the card balance, the difference is paid by any other payment method offered.
  • Buying a gift card does not earn loyalty points or referral commission: these benefits are earned on orders paid with it.
  • If the purchase order is cancelled or refunded, the card is cancelled. Any balance used on an order that is later cancelled is credited back to the card.
  • Chauvire Bijoux cannot be held liable for the loss, theft or use by a third party of a code shared by its holder.

11. Governing law & disputes

These terms are governed by the law applicable in Europe and France. In the event of a dispute, an amicable solution will be sought first: the customer first writes to bijoux.chauvire@gmail.com.

Failing agreement, a consumer customer may refer the matter free of charge to the consumer mediator to which the seller belongs (art. L612-1 of the French Consumer Code): CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France. Referrals are made online at www.cm2c.net, after a written complaint that has not received a satisfactory reply.
